Terms of service.

By engaging Homework Media for photography or media services, you agree to the following Terms of Service.
1. Usage Rights & License
Homework Media retains full copyright ownership of all photos, videos, and media created.
Clients are granted a limited, non-exclusive, non-transferable license to use the delivered media solely for marketing and listing purposes related to the specific property photographed, including MLS listings and the client’s direct marketing of that property.
Any use beyond this scope, including but not limited to commercial advertising, print campaigns, resale, sublicensing, builder or designer promotion, brokerage branding, or use after the property is no longer actively marketed, requires prior written approval and may be subject to additional fees. Unauthorized use constitutes a violation of U.S. copyright law.
Editing, altering, or modifying the media without Homework Media’s prior written consent is prohibited, except for cropping or minor formatting adjustments required by standard listing platforms.
2. Payment Terms
Payment is due in full upon receipt of final deliverables, unless otherwise agreed to in writing.
Invoices not paid within fourteen (14) days may be subject to a late fee of five percent (5%) per month. Failure to remit payment may result in suspension of future services.
Accepted payment methods include credit card, mobile payment, or other agreed-upon methods. Any billing disputes must be submitted in writing within seven (7) days of invoice receipt.
3. Rescheduling & Cancellations
Rescheduling requests made at least twenty-four (24) hours in advance will be accommodated when possible.
Cancellations made within twenty-four (24) hours of the scheduled shoot may be subject to a cancellation fee of seventy-five dollars ($75) to cover lost time and expenses. This fee may be applied at Homework Media’s discretion.
If Homework Media must cancel due to unforeseen circumstances, including severe weather, equipment failure, or illness, Homework Media will work with the client to reschedule at no additional cost.
4. Representation, Accuracy & Responsibility
Homework Media provides visual marketing media for illustrative purposes only. Homework Media does not verify, certify, or warrant the accuracy of property dimensions, boundaries, condition, features, or suitability, and does not act as a surveyor, inspector, appraiser, or advisor.
Images reflect conditions at the time of the shoot and may be professionally edited for color, exposure, perspective correction, and visual consistency. While Homework Media does not intentionally misrepresent property features, visual media is inherently interpretive and may not precisely reflect all aspects of the property as viewed in person.
Responsibility for verifying the accuracy of all property information, representations, disclosures, and compliance with applicable laws or MLS requirements rests solely with the client. Homework Media assumes no liability for claims arising from reliance on the media as a factual or technical representation of the property.
If media is altered in a manner that could reasonably be interpreted as materially changing the representation of the property, including virtual staging, object removal or replacement, or AI-assisted edits, Homework Media will disclose the nature of such alterations to the client at the time of delivery. Responsibility for how altered media is labeled, disclosed, or used rests solely with the client.
Homework Media assumes no liability for claims arising from the use of media after material changes to the property, including renovations, damage, or changes in condition.
5. Limitation of Liability & Indemnification
Homework Media shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from the use or misuse of the delivered media.
The client agrees to indemnify and hold harmless Homework Media from any claims, damages, losses, liabilities, or legal expenses arising from the use, interpretation, distribution, or reuse of the media, including but not limited to claims of misrepresentation, inaccurate disclosures, or consumer protection violations.
In no event shall Homework Media’s total liability exceed the total fees paid for the services provided.
6. Delivery & File Retention
Final deliverables will be provided digitally in standard file formats within the agreed-upon timeline, typically within twenty-four (24) to forty-eight (48) hours unless otherwise specified.
Clients are responsible for downloading and securely storing delivered files. Homework Media is not responsible for lost, deleted, or inaccessible files once delivery is confirmed. Requests for file retrieval beyond the delivery window may be subject to an additional fee.
7. Errors & Omissions
If errors or unintentional oversights are identified in the delivered media, Homework Media will correct them at no additional cost provided that:
The correction request is made within seven (7) days of delivery
The correction does not require a re-shoot
Beyond correction of errors, Homework Media is not liable for any damages resulting from such errors or omissions.
8. Force Majeure
Homework Media shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to natural disasters, power outages, equipment failure, network disruptions, or other emergencies.
9. Agreement to Terms
These Terms of Service have been updated as of the Effective Date and apply to all services booked on or after that date. By proceeding with Homework Media’s services, the client acknowledges and agrees to these Terms of Service in full. Homework Media reserves the right to update these Terms of Service at any time. Updated terms will be posted with a revised effective date.
